IndieWire Founder Heading to the Upper West Side
Eugene Hernandez, the founder and editor-in-chief of IndieWire, is leaving the online site dedicated to indie filmmaking to become director of digital strategy for the Film Society of Lincoln Center. In the newly-created post at the Film Society, Hernandez will oversee all digital initiatives for the organization, which produces the annual New York Film Festival and co-presents New Directors, New Films. He will work with current staff on the Film Society website and work to identify and secure digital partnerships for its publication Film Comment and help develop a Film Society digital channel.

And, It’s Offical: Blockbuster Declares Bankruptcy

Blockbuster, once the dominant movie rental company in the U.S., filed for Chapter 11 bankruptcy protection on Thursday, after reeling from mounting losses, rising debt and competitors that have better catered to Americans’ changed media habits. Blockbuster will continue to operate its 3,000 U.S. stores. But the move, long expected, marks the end of an era that Blockbuster and its gold-and-blue torn ticket logo helped establish — of Americans visiting video-store chains for the latest movie-rental releases. Increasingly, Americans are forgoing Blockbuster and watching movies via video subscription services like Netflix Inc., video on demand and vending machine services such as Coinstar Inc.’s Redbox.

Polanski Brings In Amazing Cast for New Flick
After the solid product that was “The Ghost Writer,” Roman Polanski had a comeback of sorts, and his next film, is coming together: An adaptation of Yazmina Reza’s acclaimed play “God of Carnage,” about two sets of parents who meet for a civilized confrontation after their kids get into a fight on the playground. As the evening proceeds, though, the conversation devolves into rage, prejudice, and homophobia. Polanski has landed a heck of a cast. Jodie Foster and Kate Winslet will play the wives, joining red-hot Oscar winner Christoph Waltz (of “Inglorious Basterds” fame) and Matt Dillon as the husbands.

Angelina Jolie has selected a lead actress for her directorial debut. Zana Marjanovic will play a Bosnian woman who is in love with a Serbian man amidst the war. Marjanovic is native to Bosnia. The movie is produced by Graham King and Tim Headington for GK Films.

Who Wants to See Another “Underworld” Movie? Kate Beckinsale Does!

It’s official: Kate Beckinsale is returning to the world of vampires and werewolves, closing a deal to reprise her role as vampire heroine Selene in Screen Gems and Lakeshore Entertainment’s fourth installment of the “Underworld” movie series. A search for a director is currently under way, as well as an actress to portray Selene’s daughter. John Hlavin wrote the script, which underwent revisions by comics writer and “The Changeling” scribe J. Michael Straczynski.

Chloe Moretz Gears Up for Another Comic Book Role

Universal is getting strange — “Emily the Strange,” that is, acquiring rights to the Dark Horse comic and character of the same name with Chloe Moretz attached to star. Dark Horse Entertainment prexy Mike Richardson will produce. The character, created in 1993 by Reger and his Cosmic Debris company, is known for sayings like “Get lost,” “Be all you can’t be” and “Wish you weren’t here.” The gothy teen has appeared on products ranging from socks to guitars and skateboards.

Mystery Writer’s Sci-Fi Spec heads to Warner

Warner Bros. has brought in “Expulsion,” snapping up a sci-fi spec script by mystery writer Gregg Hurwitz and setting it up with Brad Weston. Story centers on a small band of survivors escaping the Earth to a planet beyond the solar system after an act of terror destroys Earth.

Kimberly Pierce Hopping Back in the Director’s Chair

Universal is entering the world of faeries with “Wicked Lovely,” a fantasy project Kimberly Peirce is attached to direct. Vince Vaughn’s Wild West Picture Show Productions is producing. “Lovely” is based on the best-selling Harper Collins novel by Melissa Marr. Marr has developed series of these fantasy novels, whose titles include “Ink Exchange” and “Fragile Eternity,” with the fourth book, “Radiant Shadows,” to be published in 2010. The first book centers on a teenage girl who can see the hidden faery world but confronts danger when not only do the faeries discover her ability, but also when one king decides she must be his bride. Caroline Thompson, whose credits include a slew of Tim Burton movies among them “Edward Scissorhands” and “Corpse Bride,” is adapting the novel for the screen.

Controversial Helmer Taking on McCullers Bio Pic
The director of controversial Dakota Fanning starrer “Hounddog” is taking on the life of Southern scribe Carson McCullers with the biopic “Lonely Hunter.” Helmer Deborah Kampmeier will team with Abigail Disney’s Fork Films on the project. Sarah Schulman pens the script based on her play “Carson McCullers (Historically Inaccurate),” which played Off Broadway in 2002. Film will chronicle 35 years in the life of McCullers, who died in 1967 at age 50 and whose works include novels “The Heart is a Lonely Hunter,” “The Member of the Wedding” and novella “The Ballad of the Sad Cafe.”

Plans for a Lifetime telepic starring Hayden Panettiere as Amanda Knox are prompting legal battle cries in Italy. Lawyers for the 23-year-old American and her Italian former boyfriend, Raffaele Sollecito — both convicted in the controversial murder case and currently behind bars in Perugia — have announced they intend to take action. Titled “The Amanda Knox Story,” the Lifetime telepic is to be directed by Robert Dornheim and produced by Pilgrim Films and Television, the shingle run by Craig Piligian (”Dirty Jobs”), with plans to air sometime in 2011. Knox and Sollecito were found guilty in December 2009, after an 11-month trial, of the murder of Meredith Kercher, a British woman who shared an apartment with Knox, who at the time was an exchange student, and two others. Kercher was stabbed, with signs of prior sexual assault, according to prosecutors. The Knox and Sollecito appeals trial is now scheduled to start on Nov. 24.

Judge Lets Spielberg Off the Hook for “Disturbia/Rear Window” Fracas
A copyright lawsuit filed against Steven Spielberg was tossed Tuesday in Manhattan federal court. Judge Laura Taylor ruled that Spielberg’s 2007 sleeper hit “Disturbia,” which starred Shia LaBeouf and made about $117 million worldwide, wasn’t a rip-off of Alfred Hitchcock’s “Rear Window.” The literary agent who owned the rights to the short story filed suit against Spielberg, DreamWorks and Paramount Pictures.

Romanian Cannes Hit Finds an American Home
Lorber Films has picked up U.S. rights to “Tuesday, After Christmas,” the Romanian pic that will soon screen at the New York Film Festival. Helmed by Radu Muntean, “Tuesday” had its world preem in Cannes earlier this year. Storyline follows a man who must choose between his wife and his mistress. Mimi Branescu, Mirela Oprisor and Maria Popistasu stars. Lorber aims to kick off the film’s U.S. theatrical release at Gotham’s Film Forum in May, with engagements in select cities to follow.

Elizabeth Banks has joined cop thriller “Man on a Ledge” for Summit Entertainment and Lorenzo di Bonaventura. Sam Worthington’s attached to topline with Asger Leth directing. Former “Gilmore Girl” Latest to join Fletcher’s Helm Debut
Alexis Bledel is joining Saoirse Ronan and James Gandolfini in toplining “Violet and Daisy,” Geoffrey Fletcher’s tale of teenage hitgirls. Fletcher, who won the adapted screenplay Oscar for “Precious,” is making his directing debut on the indie drama. He’s producing with Bonnie Timmermann, with shooting to start next week in New York. “Violet and Daisy” centers on a pair of teenage assassins who are lured into what is supposed to be just another quick and easy job, only to find complications as the man they’re supposed to kill is not what they expected.

In “Iron Man 2,” Scarlett Johansson didn’t get a whole lot to do, but her main action scene as S.H.I.E.L.D. operative Natasha Romanoff, aka Black Widow, was one of the superhero sequel’s highlights. The actress is already set to reprise the role in some capacity for the “Avengers” movie, out in 2012, and now word comes from Marvel Studios president Kevin Feige that Black Widow will eventually receive her own solo film down the road. According to Feige, discussions have already begun with the actress, though nothing will happen before the filming of the Joss Whedon-directed “Avengers” flick, due in 2012.

Brit-based Scion Films has landed the film rights to Diane Ackerman’s acclaimed nonfiction tome “The Zookeeper’s Wife” with Angela Workman set to adapt. Tollin Prods. and Rowe/Miller Prods., who together brought in the project, will produce with Scion. “Zookeeper’s Wife” chronicles the true story of how Jan and Antonina Zabinski, the keepers of the Warsaw zoo, turned the zoo into a safe haven for Jews after the Germans invaded Poland during World War II. The Zabinskis hid scores of Jews in cages and sheds, as well as in their own home. The zoo soon became known by its guests — who were given animal names — as “The House Under a Crazy Star,” where humanity was tested and found. Published by Workman n 2007 by W.W. Norton & Co., Ackerman’s book spent 54 weeks on the New York Times bestseller list.

Oscar winner Charlize Theron has proffered a Dutch wink to remake rights to writer/director Elbert van Strien’s “Two Eyes Staring,” a movie originally named “Zwart Water” in the Netherlands. Theron snapped up remake rights through her production banner Denver & Delilah and is, according to Dutch sources, meeting “A-list directors” to attach to the remake. Written by van Strien and Paulo van Vliet, “Two Eyes Staring” details the story of a nine-year-old girl who discovers her sinister friend is the ghost of her mother’s dead twin.

New Deal Means Big Step Forward in Digital Distribution
For long, Hollywood has touted the promise of digital delivery of movies to theaters as a way to dramatically cut costs — a promise that has largely gone unfulfilled. But an agreement between two major players is likely to give digital delivery the major boost many have waited for. Lab giant Deluxe and satellite company EchoStar have formed a joint venture to deliver digital content to theaters in the U.S. and Canada. One of the lures of digital projection has been digital delivery — the ability to send movies to theaters as data, rather than as physical objects that must be sent as freight. Most theaters still receive movies on hard disks. The combination of EchoStar’s robust satellite network and Deluxe’s deep ties to studios is likely to be a major step forward in digitizing the exhibition business.

Looks Like It’s One More, Then Done for “L&O:CI”

USA Network has renewed the floundering “Law & Order: Criminal Intent” for a tenth and final eight-episode season with Vincent D’Onofrio back as Detective Goren. The deal the network made with series creator Dick Wolf also resulted in a pilot commitment with him. The network is in discussions with other former ‘CI’ stars, such as Kathryn Erbe, to return, but not Jeff Goldblum.

Leslie Mann has landed the lead female role opposite Ryan Reynolds and Jason Bateman in Universal’s “The Change-Up,” from director David Dobkin. Olivia Wilde also stars in the comedy, which Neal Moritz and Dobkin are producing. Script was penned by “The Hangover” scribes Jon Lucas and Scott Moore. Story revolves around a family man who accidentally swaps bodies with his best friend, a single, slacker actor. Switch-up gives each man a new appreciation and perspective.

Burton Brings Back Favorites for “Weenie” Remake
Tim Burton is casting a familiar crew for his stop-motion “Frankenweenie” remake. Voicing characters: Winona Ryder, who starred in his classic’s “Edward Scissorhands” and “Beetlejuice”; Martin Landau, who took home an Oscar for his role of Bela Lugosi in “Ed Wood”; “Mars Attacks!” star Martin Short and “Beetlejuice” and “A Nightmare Before Christmas’” Catherine O’Hara. The movie is about a man who brings his dog back to life after it is struck by a car. It is scheduled for release in March 2012, and will be produced by Disney, Tim Burton Animation Co. and Tim Burton Productions.

Great White Way Helmer to Direct True Crime Saga
Broadway director Kenny Leon (”Fences,” “Raisin in the Sun”) has been tapped to helm “Cotton,” an indie feature based on the memoir by rape victim Jennifer Thompson-Cannino and the man she mistakenly identified, Ronald Cotton. Producers David Friendly, Mark Clayman and Michael Menchel are looking to launch production early next year. Todd Komarnicki (”Elf”) has penned the adaptation. The memoir, “Picking Cotton,” is based on Thompson-Cannino’s rape in 1984, in which she later identified the 22-year-old Cotton as her attacker, leading to his conviction and life sentence. Cotton maintained his innocence and was freed after 11 years, thanks to DNA testing; Thompson-Cannino and Cotton then met, became friends and traveled together through to promote understanding of flaws in the criminal justice system.

Guy Pearce, Catalina Sandino Moreno, Seymour Cassel, Cloris Leachman and Virginie Ledoyen are “Mis-Fits.” The quintet of actors has been cast in author-playwright L.D. Napier’s directorial debut, an original comedy that she also wrote. Doug Claybourne will produce through his Make It Happen Prods., with filming scheduled to begin in May. “Mis-Fits” tells the story of a “necro-detective” who goes in search of people’s lost, dead relatives.

Writer Stepping Into the Ring to Spin Boxing Tale
Angelo Pizzo, screenwriter of sports dramas “Hoosiers,” “Rudy” and “The Game of Their Lives,” has signed on to write an indie biopic about boxer Vinny Paz, who came back from a broken neck to become a world champion. Project’s set up with producers Chad A. Verdi, Noah Kraft, Glen Ciano with Michael Corrente directing and plans to shoot in Providence, R.I., next year. Paz, a Rhode Island native who boxed under the name “The Pazmanian Devil,” is consulting. Pizzo will focus the script on the inspirational side of Paz’s story following a 1991 traffic accident that broke his neck in three places while he was at the peak of his career. Against doctors’ orders, Paz returned to the gym with his metal halo still on, began working out and eventually won three more titles and went on to retire with a 50-10 record.

Weisz Comes Full Circle, Signs On to Meirelles’ “360″
Rachel Weisz has reunited with “The Constant Gardner” helmer Fernando Meirelles for his latest project, “360.” Peter Morgan is penning the script for the pic that follows pairs of characters and their sexual encounters. Project is based on the 1900 play “Reigen” that inspired French drama “La Ronde” and has provided the dramatic structure for scores of plays and films. Andrew Eaton will produce. Weisz and Meirelles first worked together on 2005’s “Constant Gardener,” for which Weisz earned a supporting actress Oscar.

This YouTube system was devised to ferret out copyright-protected content that has been uploaded illegally to the site, analyzing images and audio tracks and automatically comparing them to protected content. Now it's being used to help monetize that content, with Google utilizing the software to identify unauthorized clips of shows like "Mad Men" then attaching ads to them, according to a report in the NYTimes. Ad revenue derived from such fan posts is then split with the content owner as part of the YouTube Partner Program. It's hard to imagine the folks at Viacom, who just lost a very expensive lawsuit leveled at YouTube over the issue of benefitting from its illegally shared content, willingly participating in such a program. Then again, what's the harm - if properly managed? The value of YouTube is that it provides a platform through which the world can admire, comment on and share bits of video. Clips of professionally produced shows have benefitted when their shows are clipped and shared by achieving a watercooler effect; now they can gain real scratch from the transaction.

Hoping to stir up Internet interest in frosh thriller “The Event,” NBC will introduce a new character first on the show’s website. A mysterious character nicknamed “The Truthseeker” will reveal information and clues central to the show’s conspiracy mythology via a blog and Twitter account. Who or what the Truthseeker is won’t be revealed on “The Event” until later in the season.

U.S. exhibitor Rave Motion Pictures has struck a joint venture agreement with Imax Corp. to install another 13 digital theatres across its circuit. Six theatres will open in November, with the rest to open their doors in early 2011. The joint venture deal is Imax’s first with Rave, the fifth largest exhibitor in the U.S. market with 61 theatres with 918 screens, and targets mid-sized markets in Alabama, California, Connecticut, Florida, Illinois, Indiana, Iowa, Louisiana, Ohio, Pennsylvania and Tennessee. As part of the joint revenue sharing deal, Imax will receive a share of a digital theatre’s box office and concession revenues in exchange for placing it into a Rave multiplex.

DGA Lines Up Its Priorities for Upcoming Negotiations
The Directors Guild of America has identified shoring up the DGA-industry health plan as a key issue at upcoming negotiations with the congloms. DGA negotiating committee chief Gil Cates made the disclosure in the DGA’s monthly magazine for October as part of a Q and A about bargaining over a successor contract. He said that employers haven’t increased their contribution to the plan since 2005 while benefits have been tightened. The guidance echoed what Cates had told members a month ago — that the DGA pension and health plans would be a top priority at upcoming contract negotiations with the Alliance of Motion Picture & Televison Producers.

Showtime has picked up new seasons of hit comedies “The Big C,” starring Laura Linney, and “Weeds.” The network cited “record-breaking premiere night ratings for both original series” in announcing the renewals Monday afternoon. The new seasons will premiere on the network in 2011.

National Geographic Entertainment is going back to school, snagging U.S. rights to Toronto Film Festival winner “The First Grader.” Directed by Justin Chadwick from a script by Ann Peacock, the critically acclaimed feature is based on the true story of an 84-year-old Kenyan man’s battle to get an education. “First Grader,” which first played at the Telluride Film Festival, stars Oliver Musila Litondo and Naomie Harris. Producers are David M. Thompson, Sam Feuer and Richard Harding.

Hot Acting Trio Sign Up for “Peeples”

Kerry Washington, Craig Robinson and David Alan Grier have been cast in the 34th Street Films comedy “We the Peeples.” Tina Gordon Chism (”Drumline”) wrote the screenplay and will direct for the first time. The story follows what happens when a child psychologist (Robinson) surprises his girlfriend (Washington) by showing up at her political family’s annual get-together at their Sag Harbor vacation home only to find them desperately in need of therapy. 34th Street’s Matt Moore is producing along with Tyler Perry Studios president Ozzie Areu, Paul Hall and Stephanie Allain. Lionsgate will release the film.

The TV movie will follow the real-life controversial case of Knox, an American exchange student who was accused by Italian authorities of brutally killing her roommate. “The Amanda Knox Story” marks the first scripted project to come from Pilgrim Films and Television, the shingle run by Craig Piligian (”Dirty Jobs”) Piligian is exec producing with Trevor Walton, Craig Anderson and Wendy Battles (who wrote the screenplay). Robert Dornhelm is directing the TV movie, which will air next year. Thirty-Five Years Later, Marvel Founder’s Grandson Starts New Imprint
In 1974, Martin Goodman, the Founder of Marvel Comics, created Atlas Comics. Next month, Jason Goodman, the grandson of Marvel’s Founder, will re-launch Atlas Comics at the New York Comic-Con. Goodman, in association with Ardden Entertainment, will release Atlas’ first two titles, “The Grim Ghost” and “Phoenix.” Both series will draw from the original Atlas library that featured stories and art by such industry legends as Neal Adams and Spider-Man co-creator Steve Ditko. “The Grim Ghost” and “Phoenix” are the first of many Atlas properties that Goodman plans on releasing.

Magnet Attracts Another Toronto Pickup
Magnet Releasing is chowing down on “Chawz,” a Korean monster movie about a rampaging giant pig. The genre division of Magnolia Pictures swallowed North American rights to the gory, tongue-in-cheek film from director Jeong-won Shin. Story tracks the killer pig’s attacks on a group of organic vegetable-picking tourists.

Demi Moore, Thomas Haden Church and Kate Bosworth are starring in “The Reasonable Bunch,” a comedy about warring exes and battling relatives at a family wedding that starts shooting this month in New York. Martin Landau, Ellen Barkin and Ellen Burstyn also are cast in the film, which is being produced by Johnny Lin and helmed by Sam Levinson, an actor and son of director Barry Levinson. The younger Levinson this year made his directing debut on “Devil in My Shoes,” which also starred Barkin. Lin, based in Los Angeles, produces through Filmula, which has been aggressively investing in movies with budgets of up to $60 million.

Moverman’s New Movie Adds Some Cast
Oren Moverman’s cop crime-thriller “Rampart” will be the first pic financed by newly formed Amalgam Features. Scripted by Moverman and James Ellroy, pic toplines Woody Harrelson, Ice Cube and Ben Foster. Recently added to the cast are Steve Buscemi, Anne Heche, Cynthia Nixon, Sigourney Weaver and Robin Wright. Set against the backdrop of the scandal within the L.A.P.D. Rampart Division in the late 1990s, film is the fictional account of a veteran police officer (Harrelson) caught up in the scandal, and his search for redemption. Producers are Lawrence Inglee, Clark Peterson and Foster.

“Avatar” Star Thinking of Heading to “Terra Nova”
Stephen Lang is in talks to play a major role in the much anticipated “Terra Nova” project from Steven Spielberg. Lang is circling the role of Frank Taylor, the charismatic and ruthless leader of the Terra Nova settlement. The news comes shortly after it was announced that powerhouse executive producer David Fury (”24,” “Lost”) is leaving the series due to “creative differences.” Fury will not be replaced, so showrunner Brannon Braga (”FlashForward,”) will now be the drama’s sole writing executive producer. The other executive producers, Spielberg and Peter Chernin, are remaining in place. “Terra Nova” is set in a dystopian future where humans live in on a dying planet. Jason O’Mara will play Jim Shannon, a father in the year 2149 who travels back in time with his family to the prehistoric era to help colonists rebuild civilization from the ground up.

Warner Set to Revisit Capone Years in “Cicero”
Warner Bros. has decided to go to “Cicero,” snapping up a screenplay on Al Capone’s origins from longtime film and TV writer Walon Green (”The Wild Bunch”). John Lesher is set to produce with Adam Kassan executive producing through their company Le Grisbi Prods. Leonard Ackerman, a producer on Warner Bros.’ 1959 film “Al Capone,” is attached to exec produce. “Cicero” details Capone’s rise from the slums of Brooklyn to the head of the criminal underworld in Chicago during Prohibition, when his gang operated casinos and speakeasies throughout the city. In order to operate outside Chicago city limits, the gangster set up headquarters in suburban Cicero, Ill., where he famously took over the city government in 1924. The script’s described as a throwback to the shoot-’em-up gangster films that Warner released during the 1930s.

The Southeast U.S. does not currently have such an outlet for filmmakers and distributors. Marking the first domestic deal of the Toronto Film Festival, IFC Films has nabbed U.S. distribution rights to James Gunn’s “Super,” starring Rainn Wilson as a husband who turns himself into the super hero Crimson Bolt after his wife is lost to a drug dealer. Pic also stars Ellen Page, Liv Tyler and Kevin Bacon. IFC will release “Super” through its new IFC Midnight banner. Gunn also wrote the film, which was produced by Miranda Bailey’s Ambush Entertainment and Ted Hope’s This Is That.

Rolling off its warm reception at Venice Film Festival, Francois Ozon’s “Potiche” has been acquired by Music Box Films for U.S. distribution. New York-based outfit Music Box is planning a theatrical bow next spring. Based on Pierre Barillet and Jean-Pierre Gredy’s hit play, the 1977-set satirical comedy has Catherine Deneuve play a trophy housewife who turns into an assertive factory manager and member of parliament. Tackling women’s emancipation with humor and melodrama, “Potiche” marks Ozon’s first comedy since 2002′ “8 Women.” Pic stars well-known French thesps, including Gerard Depardieu and Fabrice Lucchini (”The Girl from Monaco”).

Indie Distributor Nabs Rights to “Every Day”
Image Entertainment has picked up all U.S. rights to Ambush Entertainment’s “Every Day,” a drama starring Helen Hunt, Liev Schreiber and Brian Dennehy. Image will release the the film in theaters in January, followed by DVD and digital rollout in the spring. The family drama centers on a TV writer (Schreiber), whose life is turned upside down when his wife’s estranged father (Dennehy) moves in with their family. Hunt plays the wife, and Eddie Izzard and Carla Gugino also appear in the movie.

Sam Riley is set to play British playwright Christopher “Kit” Marlowe in “A Dead Man in Deptford.” The cast also includes James Purefoy, Ray Winstone, Ed Speleers and Adam Sinclair. Adapted by Michael Elias from Anthony Burgess’ novel, “Deptford” will be directed by Nick Copus for Ballpark Prods. and Neversink Prods. The movie will play with the idea that Marlowe, a notorious bar room brawler, was also a royal spy for Elizabeth I and that his death in Deptford at age 29 may have been an assassination ordered by the English Secret Service.

Voltage Pictures is financing and producing the black comedy “Killer Joe” with Matthew McConaughey and Emile Hirsch starring and William Friedkin directing. “Killer Joe” has been adapted by Tracy Letts from his play, and is being produced by Scott Einbinder of ANA Media and Voltage’s Nicolas Chartier. Story centers on a drug dealer, portrayed by Hirsch, who has his stash stolen by his mother and faces death if he doesn’t come up with $6,000. He turns to “Killer Joe,” played by McConaughey, when he finds out that his mother’s life insurance policy is worth $50,000.

Matthau Partners Up to Bring Elmore Leonard Book to the Screen

Myriad Pictures and Matthau Media are producing the bigscreen adaptation of Elmore Leonard’s comedy crime thriller “Freaky Deaky,” which Myriad is introducing to foreign buyers at the Toronto Film Festival. Charles Matthau, son of the late Walter Matthau, also will direct the pic. ATO Pictures has acquired the U.S. theatrical rights to the Kevin Spacey-starrer “Casino Jack” ahead of its world premiere at the Toronto International Film Festival. Searchlight Will Release Malick’s “Tree” (Eventually)
Fox Searchlight Pictures has acquired U.S. rights to Terrence Malick’s eagerly awaited “The Tree of Life” from River Road Entertainment. The fate of “Life,” which stars Brad Pitt, Sean Penn and Jessica Chastain, had been left hanging when Bill Pohlad, who heads River Road, shut down distributor Apparition in the wake of Bob Berney’s resignation in May. Searchlight now says it will release the film in 2011. The film, which tells the story of a Midwestern family in the 1950s chronicling the journey of the eldest son, Jack (played as an adult by Sean Penn) from childhood to his disillusioned adult years as he tries to reconcile his complicated relationship with his father, played by Pitt, was produced by Pohlad, Sarah Green, Pitt, Dede Gardner and Grant Hill.

Judge Shows More Money Love to Johnson

Don Johnson got another big payday for “Nash Bridges,” his San Francisco-set police drama that’s been off the air since 2001. Johnson sued Rysher Entertainment LLC back in February of 2009, saying he was owed millions in profits as the co-owner of the copyright to his popular show. A jury agreed, and, in July, awarded the actor $23.2 million. Judge Michael Stern added 10 percent interest for every year since Johnson and Rysher signed the deal in 1998, amounting to $28 million in interest and $51.2 million total. Though the show only ran for six seasons, it continues to air in syndication in 43 countries around the world.

SAG Makes a Deal With Its Business Reps
The Screen Actors Guild has reached a tentative three-year deal with negotiators repping about 40 of its own business representatives at its Hollywood headquarters. SAG had no comment about the pact, under which the unionized employees agreed to a contract offer with 2% annual wage increases. The employees, represented by Local 986 of the Intl. Brotherhood of Teamsters, had sought gains of 5% in the first year and 4% in the second and third years. SAG is set to begin joint negotiations with the American Federation of Television & Radio Artists on Sept. 27 for a new master feature-primetime contract with the Alliance of Motion Picture & Television Producers. Had the business agents not reached a deal, it would have raised the possibility of SAG being picketed by its own employees during the AMPTP talks.

BBC-A Brings On a Brand New COO
BBC Worldwide America has named former Dow Jones exec Ann Sarnoff chief operating officer. She will report to former Viacom colleague and BBC Worldwide America prexy Herb Scannell. Continuing to spurn Carl Icahn, Lionsgate has officially rejected the billionaire’s sweetened bid for the company, asserting that his hostile offer doesn’t fairly value the minimajor and has too many conditions. Icahn hiked his bid for Lionsgate on Aug 31. to $7.50 a share offer but insisted that Lionsgate rescind its July 20 debt-for-equity deal with Lionsgate director Mark Rachesky, or convert Rachesky’s shares into nonvoting stock. Lionsgate responded yesterday after the stock market closed in a Securities and Exchange Commission filing, recommending to its shareholders that they not tender their stock. Icahn’s offer expires Oct. 22 and he’s asked the Supreme Court of British Columbia to reverse the issuance of Lionsgate stock to Rachesky with a hearing set for Oct. 12. The company’s July 20 swap of debt for equity increased Rachesky’s stake to 29% and reduced Icahn’s stake from 38% to 33%.

After days of speculation, NBC officially announced its plans for the 36th season of “Saturday Night Live” — which kicks off Sept. 25 with guest host Amy Poehler. Judd Apatow will be one of the executive producers of an untitled HBO project written by 24-year-old filmmaker Lena Dunham. HBO has merely ordered a pilot so we won’t find out for some time if the project will become a full-fledged series, but the premise and the pedigree of the show are interesting. The series, which Dunham will write, direct and star in, will depict the “assorted humiliations and rare triumphs” of a group of young women in their early 20s. “Dark Tower” Fans, Your Long, Long Wait Is Finally Over
Universal has made it official, announcing that it’s acquired the rights to produce three films and a TV series based on Stephen King’s “The Dark Tower.” The studio had been in talks for five months among King, Akiva Goldsman’s Weed Road and Brian Grazer and Ron Howard’s Imagine Entertainment. King’s seven-book series is set in an alternate world resembling the Old West and focuses on the last member of an ancient order of “gunslingers” and his quest toward a tower that’s also the center of all universes. First book, “The Dark Tower: The Gunslinger” was published in 1982. Final book, “The Dark Tower VII,” was published in 2004. Howard will direct the first film and the first season of TV, which will be written by Goldsman — who will produce the film through Weed Road with Howard and Grazer for Imagine. Plans are for are the first film in the trilogy to be immediately followed by the TV series that will bridge the second film. Howard, Grazer and Goldsman will executive produce the TV series for Universal Media Studios.

IFC Definitely Ready to “Inhale” Rights to Drama
IFC Films has snagged North American rights to “Inhale,” the Baltasar Kormakur thriller toplined by Dermot Mulroney and Diane Kruger. “Inhale,” set to have its U.S. preem at the Woodstock Film Festival in October, will be released on IFC Film’s VOD platform later that month. Movie also gets a theatrical run starting Oct. 22 at Gotham’s IFC Center. Storyline follows a district attorney (Mulroney) who uncovers nefarious activities while on a desperate search for a doctor to save his young daughter, who needs a double lung transplant. Sam Shepard, Rosanna Arquette, Vincent Perez and Jordi Molla also appear in the pic. Walter Doty and John Claflin pen the script for “Inhale” based on a story by Christian Escario.

“Speed” Director Jumps Aboard Chinese Flick

Jan de Bont has signed up to direct Chinese actress Zhang Ziyi in an independently-produced, English-language co-production of the classic tale of Hua Mulan, the legendary young heroine soldier who joins an all-male army. “Mulan,” set to start shooting this fall outside Shanghai, is screenwriter John Blickstead’s recreation of the Chinese Joan of Arc story that was first described in a 6th century poem. The story was popularized around the world in the 1998 Walt Disney animated film of the same name. Zhang is one of China’s biggest actresses, and the new “Mulan” film comes at a time when the country’s movie business is growing by leaps and bounds at home but has scored relatively few hits overseas.

Milano to Spend “Sundays” on Lifetime
Alyssa Milano is set to star in the Lifetime telepic “Sundays at Tiffany’s.” Milano plays a bride-to-be visited by the adult incarnation of her childhood imaginary friend. Soon afterward, Milano’s character begins to re-examine her life. Eric Winter co-stars. “Tiffany’s,” which doesn’t yet have an air date, is based on the James Patterson novel. Sony Pictures Television is producing. Judith Verno, Dan Wigutow and Patterson are exec producers.
